Restrictions under section 144 of the Code of Criminal Procedure
Pune: By-election of 27 Gram Panchayats under Pimpri Chinchwad Police Commissionerate has been declared. These restrictions will remain in place till the completion of the counting process so that the by-elections can be conducted in a smooth, peaceful and fearless atmosphere and without any question of law and order.
By-election program for 503 vacant member posts in 317-Gram panchayats of Pune district has been announced. Out of which by-election of 27 Gram Panchayats under Pimpri Chinchwad Police Commissionerate has been declared. The code of conduct for this election is till December 27, 2021. Voting will take place on December 21 and counting will take place on December 22. Therefore, section 144 has been implemented till the date of counting of votes and final announcement of results.
During this period, there will be restrictions on direct or indirect misappropriation of government, semi-government, public property, and during the election period, there will be restrictions on public places, pictures of parties, placards of signs, speeches in public places. During the by-election period, it is prohibited to conduct any kind of election campaign in the Collectorate, all Sub-Divisional Officers’ Offices, all Tehsil Offices, all Government Offices and Rest House.
There will be restrictions on the use of more than 5 motor vehicles in any convoy during the by-election campaign. No person, organization or party worker may use a loudspeaker without the permission of a competent police officer. Also, loudspeakers should not be used when a moving vehicle is running on the road. The loudspeaker cannot be used in any way before 6 am and after 10 pm.
Temporary party offices may not be established near all religious places, hospitals or educational institutions and public places during the by-election period. A person violating this order will be liable to punishment under Section 188 of the Indian Penal Code, said Commissioner of Police Krishna Prakash.
Order as per section 36
Pursuant to Section 36 of the Maharashtra Police Act, 1951, the power to issue written or verbal orders have been given to all Police Thane, Chowki Swadhin officers in the Gram Panchayat area where by-elections are being held within the limits of Pimpri Chinchwad Police Commissionerate.
Announcing the conduct of a person in a procession or procession and determining the time and route of the procession or the manner in which the procession will or will not pass, as well as the timing of the loudspeakers used in public places or public entertainment events to control the publicity of the procession. Orders have been issued to control the meeting place, date and time. These orders will remain in force till December 27, 2021, the Commissioner of Police has informed.
