Mumbai: Under the Drugs and Witchcraft (Offensive Advertising) Act, 1954, the Food and Drug Administration (FDA) is taking stern action against companies that advertise drugs in an offensive manner.

The label “Gynoplus Capsules” contained an offensive text such as “Regulates a woman’s stopped menstrual period”. Since such advertisements violate the Drugs and Witchcraft (Offensive Advertising) Act, 1954 and the rules, on behalf of the Food and Drug Administration, Drug Inspector AA Raskar and Mrs P. N. Chavan had filed two cases in Shivdi court. The hearing was held and the verdict was given on 22nd October 2021. Accordingly, Dilip Bunhani, owner of M / s Nelco Biotech Indore, was fined Rs. 40,000 / – in both the cases; Gaurav Shah, owner of M / s Crystal Healthcare, Mumbai, and Devendra Khatri, Director, M / s Lloyd Pharmaceuticals, Indore, was fined Rs. 20,000 / – each.

In another case, about the ayurvedic medicine “Virulina powder”; On the label of the drug and on the website of the manufacturer Natural Solutions Nashik, an offensive text was found in violation of the Drugs and Witchcraft (Offensive Advertising) Act, 1954 and the rules relating to the respiratory system; Food and Drug Administration, Mumbai’s then Drug Inspector Shri. D A Jadhav had filed a case against Anil Kumar Sharma, owner of Natural Solutions, Nashik, and Yogita Kelkar, owner of Yugandhar Pharma, Nashik, in a Shivdi court. The case was heard on September 24, 2021. Accordingly, a fine of Rs. 10,000 / – has been imposed on each of them, according to the Food and Drug Administration.
