Trader arrested by State GST Pune Division for making false payments of over Rs.130 Crore.

State GST Pune Division arrests trader for making false payments of over Rs 130 crore. Maharashtra Goods and Services Tax Department is taking action against tax evaders. Omprakash Tirathdas Sachdev, a trader, was arrested by the state GST Pune department on June 22, 2021, from Pune for making false payments of over Rs 130 crore, according to a press release issued by Assistant State Tax Commissioner B.V. Given by Jumbad.   

             Omprakash Tirathdas Sachdev introduced M / s. Shri Waheguru Global Mines Pvt. Ltd., the company in its own name as well as M / s. Traders Bhavre, M / s. Establishment in the name of Prakash Traders, M / s Agarwal Enterprises, M / s Kolhe Sales, M / s Kiran Trading Company, M / s Narayan Traders, M / s Kashmora Trading Pvt Ltd, M / s Marikamba Trading Pvt Ltd, M / s Ciosis Pvt Ltd By taking registration certificates under Goods and Services Tax Act 2017.

          Through this company, Omprakash Tirathdas Sachdev made false payments of Rs 130.05 crore and gave input tax credit of Rs 19.79 crore to the next buyers. Similarly, in order to avoid paying this tax, he got an input tax credit of about Rs 22.48 crore from bogus purchase payments shown by many bogus companies without any direct supply of goods and services. This act is an offence under Section 132 (b) and (c) of the Maharashtra Goods and Services Tax Act and is cognizable and non-bailable under Section 132 (5). Section 132 (1) (i) provides for imprisonment for up to five years for the same offence.

           Omprakash Tirathdas Sachdev has been remanded in judicial custody for 14 days by the Chief Justice, Pune. The Pune State Goods and Services Tax Department has received information about such bogus companies and action will be taken against them in the near future.

         Under the guidance of Additional State Commissioner of Taxes Dhananjay Akhade and Assistant Commissioner of State Taxes Reshma Ghanekar, Deputy Commissioner of State Taxes Bha. Deshmukh, Assistant State Tax Commissioner Babasaheb Jumbad’s arrest was made through the efforts of the Assistant State Tax Commissioner BV Jumbad said in a press release.

१३० कोटींपेक्षा जास्त रकमेची खोटी देयके दिल्याप्रकरणी व्यापाऱ्यास राज्य जीएसटी पुणे विभागाकडून अटक.  

महाराष्ट्र वस्तू व सेवाकर विभागाने कर चुकवेगिरी करणाऱ्या करदात्यांविरोधात आपली कार्यवाही चालू आहे. १३० कोटींपेक्षा जास्त रकमेची खोटी देयके दिल्याप्रकरणी ओमप्रकाश तिरथदास सचदेव या व्यापाऱ्यास राज्य जीएसटी पुणे विभागाकडून 22 जून 2021 रोजी पुणे येथून अटक करण्यात आली असल्याची माहिती प्रसिद्धी पत्रकान्वये सहायक राज्यकर आयुक्त बी.व्ही. जुंबड यांनी दिली आहे. 

             ओमप्रकाश तिरथदास सचदेव यांनी मे. श्री वाहेगुरु ग्लोबल माईन्स प्रायव्हेट लिमिटेड, ही कंपनी  त्याच्या स्वतःच्या नावे तसेच  मे. ट्रेडर्स भावरे, मे. प्रकाश ट्रेडर्स, मे.अगरवाल इंटरप्रायजेस, में.कोल्हे सेल्स, मे.किरण ट्रेडिंग कंपनी, मे.नारायण ट्रेडर्स, मे.काशमोरा ट्रेडिंग प्रायव्हेट लिमिटेड, मे.मरीकम्बा ट्रेडिंग प्रायव्हेट लिमिटेड,                मे.सिओसिस प्रायव्हेट लिमिटेड या कंपन्या, इतर व्यक्तीच्या नावे स्थापन करून वस्तू व सेवाकर अधिनियम २०१७ अंतर्गत नोंदणी दाखले घेतले. 

          या कंपन्याच्या माध्यमातून ओमप्रकाश तिरथदास सचदेव याने १३०.०५ कोटी रकमेची खोटी देयके देऊन १९.७९ कोटींचा इनपुट टॅक्स क्रेडिट पुढील खरेदीदारांना दिला. त्याचप्रमाणे हा कर भरायला लागू नये यासाठी अनेक बोगस कंपन्यांकडून कोणत्याही वस्तू व सेवेच्या प्रत्यक्ष पुरवठयाशिवाय दाखवलेल्या बोगस खरेदी देयकांतून सुमारे  २२.४८ कोटी रकमेचा इनपुट टॅक्स क्रेडिट प्राप्त करून घेतला. हे कृत्य हे महाराष्ट्र वस्तू व सेवाकर अधिनियमाच्या कलम १३२ (ब) व (क) प्रमाणे गुन्हा असून १३२ (५) प्रमाणे  दखलपात्र व अजामीन पात्र आहे. तसेच कलम १३२(१) (i) प्रमाणे सदरहू गुन्ह्यासाठी पाच वर्षापर्यंतच्या कारावासाची तरतूद आहे.

           ओमप्रकाश तिरथदास सचदेव, यास मुख्य न्यायदंडाधिकारी, पुणे यांच्या न्यायालयाने १४ दिवसांची न्यायालयीन कोठडी सुनावली आहे. याच कारवाई दरम्यान अशा प्रकारच्या बोगस कंपन्यांची माहिती पुणे राज्य वस्तू व सेवाकर विभाग यांना मिळालेली असून त्यांच्याविरुद्ध नजीकच्या कालावधीत कारवाई करण्यात येणार आहे. 

         अपर राज्यकर आयुक्त धनंजय आखाडे आणि राज्यकर सहआयुक्त रेश्मा घाणेकर यांच्या मार्गदर्शनाखाली, राज्यकर उपायुक्त दि. भा.  देशमुख, सहायक राज्यकर आयुक्त  बाबासाहेब जुंबड यांच्या प्रयत्नातून ही अटक कार्यवाही झाली असल्याची माहिती प्रसिद्धी पत्रकान्वये सहायक राज्यकर आयुक्त बी.व्ही.जुंबड यांनी दिली आहे.
